2. Object
These General Terms and Conditions of Sale govern the sale of limited edition, numbered and signed art prints, as well as original works created by Aloïs Marignane.
3. Price
3.1 The prices indicated in euros are all inclusive of taxes, excluding shipping costs. Shipping costs are indicated when the customer places an order and before payment is made. There are no shipping costs for pick-up in Paris (valid for some illustrations only).
3.2 In case of delivery outside of France, customs duties, local taxes, import duties or state taxes may be payable. These duties and amounts are not the responsibility of the seller and are the sole responsibility of the buyer.
3.3 Aloïs Marignane may revise its prices at any time, and products will be invoiced based on the rates in effect at the time of order registration.
4. Orders and Payment
4.1 Any order implies the full acceptance of these terms of sale. These terms cannot be modified by contrary additions from the customer on the order forms, regardless of when they may have been brought to the attention of Aloïs Marignane.
4.2 The validation of any online order implies the acceptance, by the internet user, of the entire general conditions, who thereby acknowledges having fully read them. This acceptance will consist of the internet user checking the box corresponding to the following sentence: “I have read the general conditions of sale and I fully adhere to them”. The act of checking the box will be deemed to have the same value as a handwritten signature by the internet user.
4.3 Before definitively validating their order, the customer will have the possibility to check the details and total price, and correct any errors, before confirming the order to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions of these terms. Aloïs Marignane undertakes to send the customer an email confirming all the elements of the order, prior to its shipment. The customer is therefore required to provide a valid email address when registering.
4.4 By sending the electronic order form, the customer places a firm and final order. Any modification must be the subject of a new order by the customer.
4.5 Aloïs Marignane cannot be held responsible for the non-performance or improper performance of an order in case of force majeure or external cause. If Aloïs Marignane’s liability is engaged in the performance of its obligations, the customer may only claim damages that do not exceed the total amount paid by the customer as payment for the order in question.
4.6 Payment for orders placed on aloismarignane.com can be made by bank transfer, credit card, or PayPal. The accepted payment cards are CB, MasterCard, and Visa.
4.7 Payment is secured by SSL protocol.
5. Delivery
5.1 Delivery times vary between 2 days and one week for shipments. Orders for pick-up in Paris are available immediately from Monday to Saturday from 10am to 8pm.
5.2 Delivery times are given, unless otherwise stated, for informational purposes only. Any delays shall not entitle the customer to cancel the order, refuse it, or seek damages.
5.3 Delivery in Metropolitan France is made by La Poste with Colissimo tracking. Any delays do not give the buyer the right to claim damages. Deliveries to countries within the European Union are made by La Poste with Colissimo tracking for Europe. Deliveries outside the European Union are made by international postal services.
5.4 The displayed delivery times are indicative only and do not constitute a strict deadline. Aloïs Marignane shall not be held liable for any delivery delays or out-of-stock situations with the publisher or supplier.
6. Right of Withdrawal
6.1 Under Article L 121.16 of the French Consumer Code, the buyer has a right of return. For any reason, the buyer may return an item to Aloïs Marignane within 7 days following the receipt of their package (in its original packaging, by registered mail with acknowledgment of receipt, and with the corresponding invoice) to:

6.2 The shipping costs (outgoing and return) are the responsibility of the buyer. After this 7-day period, the delivered products will be deemed to be in conformity with the order and accepted by the buyer.
7. Warranty
7.1 The quality of the products cannot be called into question, and the customer is solely responsible for the choice of products. The articles provided by Aloïs Marignane are new and guaranteed against any defects. They are the same as those found in traditional commerce and come from all referenced publishers and suppliers. If an article is defective or non-compliant, Aloïs Marignane undertakes to exchange or refund it, provided that it is returned, by registered mail with acknowledgment of receipt, in its original packaging and accompanied by the corresponding invoice within 7 days following the receipt of the package, to:

7.2 The shipping costs will be refunded based on the invoiced rate, as well as the return costs incurred, if the return is justified by a defect in quality or non-compliance with the order.
8. Intellectual Property
8.1 Aloïs Marignane retains the intellectual property rights to all their illustrations and original works. The customer may use them for personal purposes or give them to third parties for non-commercial purposes.
9. Protection of Personal Data
9.1 Aloïs Marignane undertakes not to disclose to third parties the information you provide. This information is confidential. Personal data collected via the newsletter subscription form, the order form, or traffic analysis tools are treated with the utmost confidentiality. The website ensures a high level of security and is regularly updated to protect user information.
10. Jurisdiction
10.1 In the event of a dispute, French law applies and the competent courts are those of Tours, in accordance with the applicable regulations.
These General Terms and Conditions of Sale are valid from the date of order validation by the customer. By placing an order, the customer acknowledges having read and accepted all the provisions set forth in these terms.
